Hit & Run or DUI ?

So I'm eating dinner at the Pavillion Mall in Port Orange on Friday night and when I walk out of the restaurant there's about 20 people surrounding my truck. I quickly find out that the guy in the F150 Raptor I parked next to was at a local bar getting trashed and had just tried to leave. He totally mauled my truck (that was backed in and perfectly centered between the lines) completely destroying my bumper and moving the truck about 2 feet in the process. He speeds away and goes home in an obvious attempt to avoid a DUI. Luckily there was witnesses that got his plate number. The guy got a ticket for leaving the scene, but no DUI even though the police report says he could barely stand when they arrived at his home.

Had there not been witnesses I would have been totally shafted and out my $1000 collision deductible plus a claim on my insurance.

The question here is not, would you rather have a hit and run or a DUI, that answer is obvious. Hit and run is much better for you.

The question is, what the hell is the world coming to where this guy was okay with me footing the bill for his drunken booze cruise.

Worse yet, the guy is supposedly a Seminole fan according to witnesses that said he had a large Seminole head sticker. My truck has an FSU plate in the front and the back so he probably saw that.

Would anyone here have done the same and fled the scene?
 
A DUI may have very well cost him more than just the cost of repairing your truck and the associated criminal penalties. He may have lost his job too and then all the things his job supports. In that case, the choice of allowing you to foot the bill or losing much more would be an easy one.

Looks like I found the culprit! This whole thread was a trap.

Yea, I still love the truck, Enterprise gave me a brand new Dodge 1500 4x4 and I don't like it at all, not even close to the same comfort and quality.

Fun fact for you guys with F150s, the front bumper is made of metal, not plastic... I was shocked... My Tundra was plastic.

Do you really think anyone in here is going to admit that they'd hit another car and then leave the scene to try and avoid getting caught? I don't know that anyone would admit to being that big of an a-hole.

As for me, I'd stop, leave a note, try to find you, and maybe call the police myself - in order to get the paperwork started before you came out, so as to minimize how much of your time is impacted by my own negligence.
 
This is a prime example with the idiocy of our current laws and in some ways democracy itself.

You face a harsher charge for having drank adult beverages and successfully driving without hurting anyone than you do for killing someone sober.

You can actually be sitting at a stoplight drunk, rear ended by a sober driver, and be found at fault and criminally liable. Absent a death or serious injury, hit and run is a better choice.

Putt the blame where it goes: MADD, and the politicians that take their money and the voters that buy their crap hook, line and sinker.

I always thought $500 deductibles were for teenage girls and other first time drivers.

You are taking a risk if you live in Houston. FWIW, by the way, a drunk driving charge and conviction may have excluded his coverage and you would have been SOL -- unless the drunk had money.
 
The cops probably couldn't charge him with DUI. If they got him at home, he could argue he just got hammered in the past 5 minutes. If he's not trying to operate the vehicle or obviously about to, its hard for DUI to stick.

I personally know of three people convicted with DUI and held at fault for that exact scenario. This is fact and it is not debatable.

While I agree with you that the sobriety would have nothing to do with who is at fault in getting hit from behind. The other driver surely would be at fault, but of course in that scenario, if an officer smelled alcohol on your breath, you certainly would be investigated and most likely charged with DUI independently of the accident investigation
 
Ok....you are not found liable for the damages/accident. You are liable for the DUI that was committed before the accident occurred. You conflated two discriminate acts. The crime of DUI was committed before the accident, the accident has nothing to do with the crime -- other than give the cops the opportunity to find and arrest the drunk driver.

I know a guy who did pretty much the same thing. He wrecked, got out, went home (about 3 blocks) and they couldn't do anything about the DUI.

I think that's messed up.

Well from that statement it is very obvious you know very little about quality vehicles. Just kidding you!!! I hate idiots who do crap like the driver did. My wife had her new 2014 Ram 1500 Laramie less than 2 months and some idiot keyed the crap out of it. Would have loved to have someone tell me who it was. Fords are my 2nd favorite right after my Rams.

To be fair I have a nearly top of the line f150 with captain chairs leather navigation etc so it's not apples to apples with the rental Ram with a bench seat but still I just like the overall feel of the f150.
 
The legislature made it tougher on hit and runs recently. Don't recall the details but he may not be getting off as easy as he once was.

Yea, the Raptor is a nice ride for sure. You mentioned havingTundra previously, that is one vehicle that I have never been impressed with. The later models may be OK but the early years of the model was not such a great vehicle. I think even with the new ones the mpg suck.

I don't have a raptor I have a loaded FX2 which is a step above the Lariat but a step below the King Ranch or Platinum. The raptor is barely even an F150 anymore. The guy that hit me had a raptor.

As far as Tundra goes, I agree for the most part, I had an 03 back when it was relatively new and loved the reliability but the gas milage on Tundras has always been trash.

Actually I googled the guy and found out he went to University of Pennsylvania... Isn't that Ivy League or close to it?
 
If you know how to drive and have $1000 in the very very unlikely event you cause an accident, this saves a lot of money.

I have an emergency fund...it serves me better than carrying low collision deductibles, which, btw I have never used in my 41 years...ever.
