To the legal eagles on this site, what if the Judge certifies that he will not give Dalvin any jail time if he loses and then proceeds to take away his option for a jury. As a lawyer, is this a case you would feel comfortable proceeding as a bench trial? In most cases, I know the general rule is that it is preferable to have a jury, but are there some cases where it might more favorable to proceed with a bench trial?
Even before the news of an independent eyewitness surfaced who will reportedly contradict the accuser's story, the reported facts in this case screamed reasonable doubt. Judges take that bedrock principle of our criminal justice system very seriously. Is this the type of case you would like before a judge?
I hope so because Dalvin may not have an option.
