The important date for Cook and FSU - October 10

This, to me, is our first real game where we absolutely need Cook. First 4 games are completely winnable even w/o Cook. The next set of games is much tougher competition. So here is the question: if his date is in fact 9/5 and doesn't change for his hearing, will he be back for Miami game? I know nothing of legal stuff so don't know how long this could drag out, or accelerate.
