Winston case to stay in Orlando.

Judge ruled today that the civil suit would not be transferred to Tallahassee but stay in Orlando.

That's disappointing.

Astute observers believe that O. J. won his criminal acquittal when Marcia Clark decided to try the case in Los Angeles County rather than Orange County.

Ms. Cleat Chaser would have been crucified in Tally. She still may likely be in Orlando, but Jameis's odds for a landslide just took a hit.
 
I assume the civil trial will be heard by a jury. Shouldn't be too difficult to lay out all the evidence (her 3 to 5 versions of her story, lab results, the ride home on the motor scooter, not crying for help as she got into the cab in front of dozens of other people, etc, etc.) and show who/what EK and her investors truly are. I hope she is publicly drug through the gutter.

I wonder if ESPN will televise it

Oh you know they would if allowed.. They had his weekly Wedensday news conferences live on ESPN before he ever won the Hesiman. You know they would have the #1 NFL draft pick live every day.

Honestly, may be the best thing for him. I think if the Nation actually saw the evidence maybe they would think if him as they do.

Now that Jameis is in the NFL, ESPN will begin to join his side. ESPN knows better than to get too negative on the NFL, especially if Jameis turns out to be a superstar. They just fired Olbermann for his rant about Goodell and the NFL wants Jameis to win, it looks good for them. It will be like Cam Newton all over again.
 
The federal judge in Orlando handling the Winston civil suit denied Winston's motion to transfer the case to Tallahassee. This judge is a well-documented (and extreme) Gata fan, and previously chastised Bobby Bowden for writing a character reference on behalf of Gene McDowell. Not a good development for Jameis, as this Judge generally bends over backwards to move cases elsewhere. The fact that she did not do that here is interesting, at least. Winston better get some plugged-in local counsel in Orlando.....Erica has an insider Bar cronie on her team.

I'm sure Winston will have the best counsel he can get. I'll also bet the same overwhelming evidence against her can win the suit for Winston anywhere. I'd put Cornwell up against anyone. The depositions will be quite interesting.

I wish this was televised - it's really a simple story, the facts and evidence are clear - she is guilty and should be exposed nationally.

I believe people have said, assuming this goes to trial, that it will be minimum summer 2016 before it sees a courtroom. That sounds about right.

The more popular Jameis gets in the area amongst the Bucs/Orlando and Tampa areas, the better it will be for him by the time it goes to trial.
 
Will the judge that denied the change of venue now be hearing this case at trial?
 
Honestly, this was the right decision. It's fairly dubious for Jameis to claim the north district is more convenient to him than the central. I understand why they made the motion, but the judge is right.
 
Gator fans already lamenting that the "long reach" of FSU power will be able to effect the case in Orlando...since clearly we have the FSU police/TPD/SA office/Retired Supreme Court Justice/etc in our back pocket....

I don't think it will be. I'd still put money on this never going to trial. Right now I think she's playing a game of chicken hoping he ducks first.

Respectfully, this is a bit naïve. Certain judges have "favorite attorneys" who almost never lose no matter what the facts or evidence may be. Yes, even in the sacred federal system. Jameis is at risk here, even if his Atlanta-based lawyer (a) may not realize it; or (b) may not want to admit it to his client. This ruling -- especially from this judge -- is surprising (i.e., the generally slothful Gata judge is going out of her way to "keep" the case, which can't be a good sign for JW).

True...however, if Cornwell etc think there would be grounds for bias at the end of the case, they could always appeal. Especially if there is overwhelming evidence in JW's favor and/or judge shows prejudicial entries of evidence or lines of questioning in favor of EK's side vs. his.

LOL. FSU's "power" is pretty limited, as confirmed by our failure over the past 30 years to get Willie Meggs under some semblance of control.

If this judge is ambitious (and to make it to the Federal level, I think it is safe to assume she is ambitious), I am sure she believes to be the presiding justice in this high profile case would be quite the feather in her cap...potentially lots of publicity for her...securing justice for abused women every where...

You obviously do not know her. She is on the brink of taking so-called "Senior Status" -- which enables her to work a partial schedule and decline any case she does not wish to handle -- so "ambitious" would not be the right word. I am quite sure she does not want or need any publicity, or any feathers in her cap. Like so many judges, she sought refuge on the bench to avoid the escalating rigors of private law practice. Her decision to keep this case -- when she could have easily (and correctly) sent it elsewhere -- is not a good sign for Team Winston.

You are absolutely correct, JHN. I have never met this woman and have no knowledge whatsoever of her career. Kudos to you, though, for being in the know!
