Winston isn't contesting where he resided at the time of the suit (though doesn't admit it either... simply: there is diversity... because plaintiff's "complaint alleges" that Winston resides in Alabama and plaintiff resides in Florida). Then claims that the amount in controversy is > or = 75,000. Submits documents that tend to show they seek more than 75k. Tries to consolidate the case with FSU's as well.
I don't recall if there's anything unique about the FEC v. FRE as it pertains to rape cases (civil or criminal), but maybe that works to JW's advantage. Perhaps he wouldn't win trying to change the state court venue because he resided elsewhere at the time, so they're just accepting that portion & moving forward. Have to think that EK's attorneys do not want this case consolidated.
