Jameis won't be able to hide behind a written statement like he did in the conduct hearing. He's going to be deposed and perhaps crossed examined by her lawyers. Hopefully there's no damaging stuff they will be able to dig out of him.

I'm not so sure. Look what they did to Mike Tyson by digging into his past.I think Clune is overestimating how much digging into Winston's past matters at this point. Wnston is a high profile public figure that has been torn to shreds in the press. His whole life has been picked apart. What does it matter at this point if he is deposed? They bluffed and Winston called it. The girl is not winning a civil suit that Winston chooses to fight. It's just not going to happen. Furthermore, if Cornwell has some Aces up his sleeve like phone records, she might end up in jail.
This what I wish Winston would settle his case for.
- She gives all money she made from this to Winston.
- All documentaries are immediately banned from being sold. Must be edited to remove everything about Winston. Must add a statement in the beginning about how she lied and how the director did nothing to validate the facts of the case and this documentary is a work of fiction.
- She must go on national TV and admit she lied in detail.
- For 10 years, she has to put a statement about how she lied on top of her resume.
- NYT, Tampa paper, etc must print full & front page retractions and mention how she lied and they were duped and are a worthless news org.
- Matt Baker must print the truth about his relationship with the family.
- Gator lawyer must admit she took the case to embarrass FSU and give up her law degree.

Dude has a point. Don't get me wrong: the plaintiff is lying white trash. That much is clear. But Winston's counterclaims are not without legal and strategic distractions. For starters, he is already a "public figure," and winning defamation claims against public figures is not easy. Second, Kinsman's lies were told in the context of police or administrative proceedings, so she has at least a qualified privilege to give her version of the facts (even if they turn out to be dead wrong). And because Winston has now placed in issue his "good reputation," Kinsman will have a chance to show that his reputation may not have been pristine to start with.
We all enjoyed reading Winston's version of the facts, and it is obvious that Kinsman lacks credibility (and personal values, etc., etc., etc.). But this will not be the slam-dunk some are predicting.
This is quite the depository of information that media people will need to completely ignore if they are going to continue to slam Winston. Has anyone sent a copy to Joe Scarborough?

I agree with Winston's counterclaim, I've been posting on here for a long time that he should sue her.
But they're not gonna make it painless for him. He'll have to air his dirty laundry and the media will be there scrutinizing every sordid detail.

One thing I am not sure I understand is why they added the interference with prospective business relationship claim. All of the damages he would receive in that would also be recoverable as defamation damages. I am not sure of the elements exist for the interference with business relationship claim. I don't know that I would have raised a duplicative count that may not survive a little challenge because even something completely irrelevant to the endgame would be pounced upon by the media as a loss for Winston in the litigation.
If they want to take his deposition, they'll subpoena him and he'll have to testify. Relevance standard in discovery is very broad.

Where would they go to attack his "good reputation?" We all ready know about the BB guns, Crab Legs, FHRITP, etc. Where else would they go? The kid got accepted into Stanford out of high school and had a 4.0 GPA out of high school. He was all ACC and academic honor roll every semester in 2 sports.

The fact that you already know about his other offenses does not mean they are not relevant. And maybe there are other incidents that we don't know about. Maybe there aren't. But this door is now open for Kinsman to investigate.
