Neighbood Drama...thoughts?

So, our neighborhood HOA pushed out a revised parking policy for our gated community.

OLD POLICY (summary): No overnight street parking
NEW POLICY (summary): No street parking between 1am and 6am. Visitors requiring overnight parking must submit a waiver 48-hours in advance. No blocking the sidewalk or spilling out into the street (doubling up cars in driveways blocks the side walk)

We have a 4-car tandem garage (basically a longer 2-car garage), but lost most of the usable parking space due to our elevation that required an 8' stair case be erected inside the garage. Therefore, we have one car in the garage, two in the driveway, and one in the street. AND we've submitted a waiver request.

Our nextdoor neighbors built their home with a 3-car garage and moved in about a year ago. They have a large lawn trailer, FOUR trucks and a car. Since living here they've been parking 1 or 2 in the street (no biggie, so do we). After the policy update, they started double stacking five vehciles in the driveway, thus blocking the sidewalk. Ok. No biggie.

Yesterday, the wife posts this gem on our community FB page:

Hi everyone! We're somewhat new to the area. Just found out about this page by another neighbor. We deliberately moved into a gated community w/a stringet HOA. Something we did not have before. We absolutely love the no vehicles on the street policy. Our old neighbors would leave their vehicles parked in front of our home 24/7. It created a lot tension between us. We did read HOA rules prior to moving into the community and that is why we selected AR. Now to see that others are attempting to go around the rules is very disappointing. Rules are rules no matter what. That's our take.

Now we're all arguing about this on the page. These are people we welcomed to the neighborhood the week they moved in with a gift basket and an invite to dinner. We've had many great interactions/conversations and now this passive aggressive post and follow-up justifications for her "opinion."

Funny thing is, she's violating THREE HOA rules while touting "rules are rules"? I've given a few responses, but want to go for the throat...

okay...that's one option.

I'd like to consider a few others before committing, though. You understand.
I get it - leaving your options open.

In that case I'd photograph each and every instance in which they violate one of the parking rules. If they continue to reference you in their holier than thou posts, then return fire by posting the pictures of their vehicles illegally parked and throw in a "people with glass houses..." shot.

I've already got photos of their big "support'n our troops (aka: sons)" sign in their front yard. Clear violation! LOL

What's wrong with on-street parking? It calms traffic and creates a buffer between moving vehicles and the sidewalk.

Oh, and please post the link to said FB page so we can all pass judgment on the neighbor.
 
You said the waiver request was for visitors to park overnight, which means it's temporary. How can you as a resident use the waiver for permanent overnight street parking? Or did I not read the post correctly?

Waivers (for personal use or visitors) can't exceed 7 days. Yes, I left that part out. So, once approved, I'll resubmit my request every week until my kiddo returns to school next month.
 
Oh, and now she's playing the we have 2 children who just joined the military, one about to, and a husband who is a fireman. What does that have to do with anything? I served 20 years and I'm now a disabled vet...has ZERO bearing on the topic. smh

Yes, Mary, they are inconvenienced from the few that we've spoken too. They don't want to have too move one car in and out of driveway daily, so it's inconvenient 'for them.' Much easier to submit waivers. We have good friends that live in the community as well that is how we found this area and they've heard same thing. Seems like I hit a nerve with few people on here. But I'm merely sharing my point of view as to why we built our home in AR. Have some consideration and "compassion" for that. We can still be kind, understanding, loving neighbors. Just because I am not agreeing w/your view doesn't mean we can't continue to be Christ like to one another. Again, the people I've personally spoken with ARE DOING OUT OF INCONVENIENCE. We too are a family of 5 and we all own vehicles. We take HOA rules into consideration when our boys come home from the military to visit.

Everything about your neighborhood sounds horrible.
And it's getting worse. My 16 year drove to the pool last week and was turned away because she wasn't 18 and didn't have a parental escort. She's been going to our pool alone since she was 13.

Oh, and another rule we have is no fireworks...HOA sent out an e-blast reminder. Do you think that mattered? It was like Iraq Shock-n-Awe! ...guess that rule doesn't count.
 
Apparently, our neighbor was just volunteering her opinion (out of the blue). Nope. Nothing passive aggressive about her post at all (as she looks out her window to our cars in the street).

She's been here a year and THAT is her first public communication.

Does your HOA rules exceed those of the broader community or simply reinforce existing ordinances? Could make complaints to either HOA or local authorities if so.
 
If I ever get my hands on a good tank, I'm gonna flatten every damn car parked in the street in our neighborhood. All our houses have two driveways and there is no reason for it. It is always the same houses with the same cars ever friggin day.

Our HOA took the existing DCCRs; specifically in regards to parking, and broadened its scope to include repercussions. $50 fine for each offense and towing after the third. Here's the amendment. It's long. Sorry.


II. RULES & REGULATIONS
Homeowner's Responsibilities: All Homeowners are responsible for ensuring that their family members, employees, visitors, guests, tenants and agents observe and comply with all rules and regulations as adopted by the Board of Directors

1. The speed limit throughout all The Preserve neighborhoods is 20 miles per hour
2. A resident's garage and driveway shall be used by the resident, their family members, employees, visitors, guests, tenants and agents prior to parking on the street
3. Overnight parking is defined as beginning at 1 A.M. and ending at 6 A.M. No vehicles are permitted on the street during this timeframe.
4. Limited exemptions may be allowed to the overnight parking policy. All requests for exemptions will be considered on a case-by-case basis.
a. Requests for exemptions must be submitted to the HOA Board of Directors (BOD) no less than 48 hours before the exemption is required. Exemptions for Friday, Saturday and Sunday nights must be submitted no later than 5 P .M. of the preceding Wednesday.
b. Exemption requests submitted with less than 48 hour before the exemption is required will only be considered for emergencies, at the discretion of the BOD.
c. The BOD will review each request and issue an exemption notice.
d. Exemptions will be for NO LONGER THAN SEVEN (7) CONSECUTIVE DAYS. Multi-day exemptions will not be issued for non-consecutive days.
e. Homeowners can request a new exemption for each ensuing period prior to the end of their current exemption.
f. Homeowners may request exemption notice for guests whose vehicles cannot be parked on the homeowner's driveway or in the homeowner's garage.
g. Homeowners whose driveway or garage cannot be used for parking one of their own vehicle due to a temporary obstructions (i.e. construction equipment) can request exemptions.
5. It is prohibited to park any vehicle on any non-paved common area or on any non-paved private property
6. Driving or parking on sidewalks is prohibited
7. Vehicles, either parked or stopped temporarily, may not prevent ingress or egress of another vehicle from any driveway
8. Vehicles, either parked or stopped temporarily, may not block a sidewalk or extend into the street.
9. It is strictly prohibited to double park on any street.
10. No parking within 15 feet of a fire hydrant, mailbox or stop sign.
11. Vehicles must be parked with the flow of traffic.
12. Cul-de-sacs: Vehicles parked in a cul-de-sac must be parked parallel with the flow of traffic with both front and back wheels on the passenger side within 18 inches of the curb
13. Repairs: Only emergency repairs may be made to vehicles in the Preserve's community.
a The Preserves community includes homeowners' driveways, but does NOT include a homeowner's garage.
b. Emergency repairs are defined as flat tires, dead batteries, and broken windshields.
c.. Major vehicle maintenance, including but not limited to painting of vehicles, drainage of automobile fluids and engine repairs, are not permitted anywhere in the Preserves' community.
14. The operation and parking of motorized vehicles in The Preserves' community shall be restricted to paved roadways and ingress/egress via private driveways.
15. All vehicles in the Preserves' community must be legally registered, insured and operable
16. Vehicle Storage: Homeowners may not use a private driveway to store vehicles. The following guidelines are used to assess whether a vehicle is stored rather than parked:
a. The vehicle has not moved in 30 days .
b. The vehicle's registration is not current
c. The vehicle is in an obvious state of disrepair (flat tire, broken windows, major damages, etc.)
17. Vehicles determined to be abandoned on the HOA property will be towed at the HOA's discretion. A vehicle is considered abandoned if it is not parked in a private driveway and meets either of the criteria listed below:
a. If it has not been moved in four ( 4) days
b. If it lacks either a current license plate or valid state registration.
18. It is prohibited to park/store recreational vehicles in open view on driveways, or on roadways. AJl recreational vehicles must be parked/stored out of site when not in use.
a. Residents needing to park recreational vehicle on driveways or on roadways in order to prepare the recreational vehicle for use must notify the BOD no less than 72 hours ahead of time.
b. Recreational vehicles may only be parked on driveways or on roadways for 48 hours while being prepared for use.
c. At no time may a recreational vehicle prevent ingress or egress of another vehicle from any driveway
d. At no time may a recreational vehicle block a sidewalk or extend from a driveway into the street

Ill. ENFORCEMENT

I. Enforcement agent will regularly patrol the Preserve at Alamo Ranch
2. Enforcement agent upon observing a violation will document the make, model, and license
plate and confirm with a photo
3. A notice will be placed on the vehicle identifying the violation and provide a time period
to resolve the issue
4. Enforcement agent on the second sighting/violation will verify the same make, model and
license plate number matches with the first notice
5. Enforcement agent will forward information to the managing agent
6. Managing agent will forward a copy of the Parking and Traffic Safety Policy to homeowner
via regular and a demand letter via certified mail fining the homeowner fifty ($50) dollars.
7. Upon third violation the managing agent will have the car towed and post a letter stating
that the car was towed with information regarding the towing company.

IV. TOWING POLICY

1. The association shall exercise its right to fine and tow any vehicle determined to be in
violation of this policy.
2. The Association shall contract with a professional towing company which is authorized to
operate within the area to provide the towing service.
3. The Association shall administer a towing policy for the enforcement agent, the towing
company and the managing agent.
4. Enforcement agent shall patrol the community a<> established by the Board and will report
any vehicles found in violation to the association.


Parking is serious business!
 
Have you thought about target practice in your backyard with large firearms? The restrictions were tl;dr, but I'd assume there was nothing about noise ordinances in there.

Build a berm in the back of your yard, not the side though. Show them passive-aggressive.

That's just the parking addendum. THere's 44 other pages and yes noise is one of them.

No exterior speakers, horns, whistles, bells or other sound devices (other than security devices used exclusively for security or public safety purposes) shall be located, used or placed on any of the Property such that it becomes or will become clearly audible at the property line of adjoining property owners. No noise or other nuisance shall be permitted to exist or operate upon any portion of the Property so as to be offensive or detrimental to any other portion of the Property or to its occupants.

3.30 Hazardous Activities. No activities shall be conducted on the Property and no Improvements constructed on the Property which are or might be unsafe or hazardous to any person or property. Without limiting the generality of the foregoing, no firearms or fireworks
shall be discharged upon the Property, no open fires shall be lighted or permitted except within safe and well-designed interior fireplaces, or in contained barbecue units while attended and in use for cooking purposes.
 
my god suburban life sounds awful... this is what people freak out about?

sell the house, move into a condo building, no lower than the 12th floor. enjoy life.

In that case, some Hi-Fi speakers in the house, turned up to 11, playing artillery sounds all night while you go on vaca. Not placed on the exterior of the house and not real fireworks or firearms.

theoretically you can get away with some target practice if stated for the purpose of security / safety readiness.

One more thing...does she specifically call you out? In your op her statement is, "Now to see that others are attempting to go around the rules is very disappointing..."

Maybe she's talking about someone else and you got a little self defensive and opened up uneeded bs?

This all transpired last night and I'm at work today. I plan on going over there when I get home.

We don't double park, we just have one in the street. She sees no issue with what she's doing. Her comment:

We own 4 LARGE trucks, one trailer and three mid size vehicles.

She says that, BUT fails to mention they didn't follow the rules for a year prior to the revision and in making attempts to adhere to the updated policy, they wound up breaking a different rule. Personally, I've never cared where they park...I'm certainly not one to throw stones from a glass house, but don't call me out passively and act like you're some saint.

She also had this to say, "Rules are rules. In my opinion, submitting a lot of waivers is a way to try to get around the rules."
 
I wouldn't think this would that big of a deal in a flat area. But up here large hills and sharp turns are common. There for a while we had a neighbor park at the top of a hill forcing people to go blindly around into the oncoming lane. The main neighbor that did this hasn't done it in a while so the HOA must have got them to stop. Most people are either don't think their actions through on their own or just don't care.
