question for the lawyers-neighbors tree

their tree straddles the property line but several branches hang over my property line and are low enough I couldnt drive my mower under it. Legally can I trim the trees w/o their permission? Ive always got along with this neighbor, in fact their dog got loose and bit mine and I didn't file a complaint...
 
If you get along, how about knock on his door and ask him if he doesn't mind if you trim a few branches so you can walk under it?

that ship has sailed. We've got along in the past, he regularly borrows my truck so I didn't think it was a big deal..
 
no, I cut them thinking it was no big deal. He's all upset and his freaking wife, not him, came over to my door and complained.

As someone pointed out this dude owns you and any advice is prolly a waste at this point but I'll try.

Any portion of any tree that hangs onto your property, you have the right to remove/trim. Period.

I had this issue a few years ago, so I asked and trimmed away.
 
Tell him all you wanted to do was cut his tree and you have no interest in trimming his wife's bush. So please stop sending her over.

I think she privately wanted you to trim something for her. The window may now be closed, but she was definitely asking you to handle some of her trimming. Remember that women often talk in code.

I'm a former Marine, Old Sport, but being nice never goes out of style.

Do you have a picture of before/after? Doesn't really matter because you had the right to cut but would be curious about why they got so upset.
 
Limbs hanging on your side, you can cut them. At least in the state of Florida. I've had to squash this issues several times at work (LEO). It's silly the things people freak out about.
