Maybe or maybe not. I think the subject person would be the deciding factor.
I dislike these rules/laws , that when you go granular there's always room for subjectivity by the person enforcing it. It brings out these people who try to push the envelope; and on the flipside those that enjoy their authority too much.

To quote the twice permabanned Free Spirit-Brian-Lurker;

"Not all of my posts are stupid; many get hundreds of views and turn into multipage threads. I'm trying to generate some discussion on this board because it's dreadfully dull and boring because of overmoderating.

The LR is a shell of it's former self and it's sad how far it's fallen.

I assure you there are many other old time posters that feel the same way; many of them don't even bother to post here anymore.

If you want to ban me for speaking the truth about how far the LR has fallen, go ahead...whatever makes you feel good about yourself is fine with me..."

This is not my board, apparently, I just over moderate it. So, denizens of the Locker Room, you decide his fate.
I haven’t read thru this thread, so take it for what this worth. I currently abstain.
As long as there are no personal insults or general BS, I lead towards letting someone be, but we can’t change history. There were obviously issues in the past that are none of my business. If you ask to be let back into a joint and are given access with stipulations, either adhere or don’t let the door hit ya where the good Lord split ya.
I do feel like the lurk is trying to egg DFS on and that, my mama says, is “acting the fool”. Jim has been very fair handed while staying within the structure he has to adhere to on these boards. He may wanna let us cut loose, but the call is not his to make.
On the other hand, brian does bring some topics to the table that bring participation, which is a positive. Those other topics we can choose to not respond to or even mash that ignore button. (I have hit that on rare occasions over the years accidently, but never on purpose. Surely one can stay away from someone without the aid of Ignore.)
My main concern is that once we start picking winners and losers, age is an easy line to use... and I reside well across the ancient line.
