Yearly article- Tallahassee man missing (Mike Williams)

Just because she said she wanted him declared dead, legally, doesn't mean she was in on it. I personally believe she was but declaring him dead doesn't make her a conspirator. It makes her an awful human but not legally a conspirator.
 
Here's the thing though, we all know she was in on it, but if she has half way decent lawyers the "zero sense" argument is pretty easy to spoil. He was a whack job (he's a confessed murderer after all) who had delusions that if he killed Mike he could be with Denise forever and share the insurance money that he knew about.
The only thing that's gets her in my mind is how quick she wanted to have him declared dead. Seems like they could get her on insurance fraud, but off on murder.
Hopefully there are texts between the 2 of them that prove her guilt,

Agreed. There's a substantial difference between being a bad human who was probably in on it to being a murderer beyond all reasonable doubt. And frankly, similar to Wendi Adelson, there's also a difference between kinda knowing a murder is going to happen in advance and ordering or planning that murder. Although I do agree a jury would likely whack her if they were convinced beyond a reasonable doubt that she knew what was going to happen before it happened.
 
She was trying to get the life insurance in the works during the search for him. That’s pretty cold and also would seem she knew he would never be coming back during the search. Not to mention she threatened mikes mom that if she didn’t let it go and ever got a criminal investigation on his disappearance she would keep Anslee away from her. Using the child as a pawn will not sit well with any jury but as I stated in previous posts there are texts and calls in evidence.
 
Funeral service is open to the public for Mike. It’s Sat Sept 8 at 11am, at Immanuel Baptist Church. There will be a private burial afterwards.
 
What day is the trial set for or next appearance in court? Are they still thinking October?

The request was granted during a pretrial hearing on Wednesday morning.

Williams was set to stand trial September 24th for the December 2000 murder of her husband, Michael Williams.

A new trial date has not yet been set.
 
Of course there was a delay because why wouldn't there be? Look at the Markel case.

As long as she is in jail she can take as long as she wants before starting the trial...

Hmmm.... Sounds like some people reside outside the area. It will be interesting to see who they are looking to depose.

Someone mentioned that Brian's ex lives out of state.

Quick question for anyone who knows: In a criminal trial, does the defense get depositions from individuals who are already on the State's witness list? People whom the state intends to use as witnesses have already given statements to the State and the defense will cross examine them at trial.

I don't know the ins and outs here - does the defense subpoena, serve and get statements from prosecution witnesses before the trial?
 
Why wouldn't they just wait for the first trial to be over before doing this story? Its so close, it would make more sense.

I’m surprised it’s on tonight as well. Per Ms.Williams she did not partake in any of this because she does not want it to influence the trial (saw that on the FB page yesterday).
 
I watched it. Honestly there wasn’t a lot in it that hasn’t been discussed already. Here are a few:

One thing I didn’t know was that Mike was shot in the face at point blank range.

I was a little surprised that the Ketchum’s (where Mike worked- Ketchum Appraisers) played a role in the interview process for the show. I recall them thinking Mrs Williams was off her rocker for a while. That’s not the perception the show gave. However I believe Mr Ketchum was a pallbearer at Mike’s funeral (or at least had his name on the brochure at the funeral) so there may have been some reconciliation between Mrs Williams and the Ketchum’s. And this is in no way a shot at the Ketchum’s. Almost everyone thought Mrs Williams was just trying to find something that wasn’t there. Many were wrong.

FYI- Derrick Wester, who was interviewed, the county officer for Lake Seminole, helped Mrs Williams in the investigation a lot...
 
The show also mentioned that Kathy (Brian's first wife) either knew or suspected that Brian and Denise had been having an affair for years. In her most recent interview with FDLE, Denise stated that she and Kathy were still friends. This is an interesting dynamic to say the least. December 10 can't get here soon enough.

Wasn’t it revealed that they were having a 3-some (Kathy, Denise, Brian)?
Also, I didn’t know the Marianna authorities had a guy who identified Brian as being near Lake Seminole the day of the murder. Guess LE would have kept that close to the vest for all these years.

I watched it last night. Her defense lawyer said he will have one questions for Winchester. "Did you shoot your best friend at point blank range, in the face with a shotgun?"

Will be an interesting trial.

The defense looks like its going to be pretty "simple".

The State does not have another individual who is going to testify that Brian and Denise conspired to kill Mike Williams. Brian has already stated - and will testify once again - that he solely killed Mike. Based upon these two facts, they believe she will be acquitted for murder and conspiracy.

I believe the defense will call other people to the stand that will cast doubt upon some of what Brian has testified to, leaving the jury little choice but to acquit.

The jury isn't going to see this how we who have followed it for 15+ years see it. They will likely see a confessed murdered trying to pen the act on his ex-wife that he was looking at 20 to life for kidnapping. And the defense will point out again and again that anyone would lie for immunity from murder and for a reduced sentence for kidnapping - and this person's word is all you have to send someone to prison for life. Not happening.
 
The one thing that was mentioned on the show that I was not aware of was that someone picked Brian from a picture lineup for a person that was seen that morning at the lake. I assume the the law pushed him on this and he didn't crack. I know this does not make their case, but it seems that they would have brought him in for questioning since it went against his alibi.
 
What happened to his truck? If he drove with a bloodied body in his car there would be DNA evidence. Also, he said he pushed Mike in the water and shot him while both panicked. Did he jump in and get the body? Was there blood all over the boat? Winchester’s DNA on the boat?

Denise getting $2.25 million in total benefits from Mike's death.

"The insurance paid off. We had to be very careful about our relationship being found out. So we were very careful," Winchester said.

Denise was listed as the primary beneficiary for all three policies.

Nineteen days after Mike was reported missing, one of the insurance companies received a claimant's statement from Denise and Winchester. The cause of Mike's death was listed as an accidental drowning.

When the other insurance company requested a claimant's statement, Mike's death was listed as a hunting accident. In addition, documents state Denise did not tell the second company about the $1 million policy that she had already filed a claim for.

By November 2001, Denise had received death benefit checks totaling more than $1.75 million.
 
The insurance fraud charge is much, much easier. But it, again, does not prove she conspired to murder Mike.

TALLAHASSEE, Fla. (WCTV) -- Prosecutors are seeking an emergency court order in the murder trial of Denise Williams.

Williams is accused in the murder of her husband Michael Williams back in December 2000 and is set to go on trial in December.

The motion, filed late Wednesday, asks a judge for a protective order to stop the defense from conducting phone surveys of potential jurors, which they claim go beyond asking questions about the case to relaying facts about it.

Court documents show the motion was filed after an Assistant State Attorney received information from a Leon County resident that they had received a phone call asking them a series of questions about the Williams case.

The motion contends that after the questions, the caller then proceeded to give a rundown of the facts of the case.

Prosecutor Jon Fuchs calling that "reckless" and claiming "it violates the sanctity of the court."

That same court document states that Denise Williams' defense attorney Ethan Way admitted to hiring a group to conduct the survey, but denied telling the caller to read the facts of the case. Way, the motion says, said he hired a company to conduct the survey for purposes of potentially seeking a Change of Venue.
 
I still don't see the connection that kills reasonable doubt. Sure, I think she's guilty but where is the connection that ultimately says she's guilty beyond a reasonable doubt
